Vernachlässigung und mangelnde Fürsorge

Zusammenfassung

Eine Definition des Begriffs »Kindesvernachlässigung« hängt davon ab, welche Fürsorge für Kinder als ausreichend und welche als Vernachlässigung bewertet wird. Dies ist von gesellschaftlichen Normen abhängig, die einem ständigen Wandel unterworfen sind. Bei Vernachlässigung und Verwahrlosung können als Normen nur sehr abstrakte und wenig konkrete Rechtsgüter herangezogen werden, wie z. B. das Recht der Kinder auf eine möglichst weitgehende Verwirklichung ihres Entwicklungspotenzials. Vernachlässigung ist zu definieren im Spannungsfeld der Rechte des Kindes gemäß der UN-Kinderrechtskonvention und der Verantwortung von Eltern und Gesellschaft, diese Rechte zu verwirklichen.
