Zusammenfassung

In Deutschland ist Krankheit als „ein regelwidriger körperlicher, geistiger oder seelischer Zustand, der Arbeitsunfähigkeit oder Behandlung oder beides nötig macht“ definiert (Entscheidung des Bundessozialgericht s (BSG) vom 16.05.1972, 9RV 556/71). Den gesetzlichen Krankenkassen (GKV) liegt nur eine juristische, nicht aber eine medizinische Definition für Krankheit vor (BSG Urteil vom 10.04.2001, B1 KR 39/99 B, RegNr. 25284). Für die Weltgesundheitsorganisation (WHO) ist Gesundheit ein „Zustand des vollständigen körperlichen, geistigen und sozialen Wohlergehens und nicht nur das Fehlen von Krankheit oder Gebrechen“ (WHO 1946).
