Zusammenfassung

Grundsätzlich gilt für den Notarzt des öffentlichen Rettungsdienstes dieselbe Verpflichtung zur Leichenschau wie für jeden anderen Arzt. Allerdings sind die landesrechtlichen Vorschriften in Bestattungsgesetzen, Rettungsdienstgesetzen und Leichenschauverordnungen zu dieser Frage uneinheitlich oder treffen keine explizite Aussage. So haben die meisten Bundesländer in ihren Bestattungsgesetzen den Notarzt des Rettungsdienstes von der Verpflichtung zur Leichenschau ausgenommen, da er für seine originären Aufgaben der Abwendung von Lebensgefahr frei sein soll. Für den Fall, dass sich kein KV-Arzt, der zur Leichenschau verpflichtet ist, finden lässt, soll nach dem NRW-Bestattungsgesetz das Gesundheitsamt (»Untere Gesundheitsbehörde«) für die Leichenschau und Ausstellung des Leichenschauscheines zuständig sein. Allerdings ist denkbar, dass auf kommunaler Ebene geregelt wird, dass das Gesundheitsamt in dieser Frage durch den Notarztdienst vertreten wird (so wie mancherorts das Ordnungsamt in Unterbringungsangelegenheiten (PsychKG) durch den Leitungsdienst der Berufsfeuerwehr vertreten wird).
